Limited Lifetime Warranty for SMART DISPLAY Products

This Limited Lifetime Warranty warrants to the original purchaser of this Smart Display product for it to be free from defects in material or workmanship for as long as the original purchaser owns the product.  SMART DISPLAY 's obligation under this limited warranty shall be limited to the repair or replacement of the defective part or product (or an equivalent type and quality part or product if the exact item is not available) through which our examination shall disclose in our sole discretion to be defective.  All warranty claims shall be submitted only to SMART DISPLAY, or their Authorized Dealer, along with the original sales receipt or purchase order.  In filing any warranty claim, the original purchaser shall be responsible to prepay the packing and shipping cost if the product needs to be returned to SMART DISPLAY or their Authorized Dealer.

THIS WARRANTY AND THE OBLIGATION OF SMART DISPLAY HEREUNDER ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED AND OF ALL OTHER OBLIGATIONS OR LIABILITIES INCLUDING ANY LIABILITY FOR CONSEQUENTIAL DAMAGES.  THIS WARRANTY SHALL NOT APPLY TO ANY SMART DISPLAY PRODUCTS THAT HAVE BEEN SUBJECT TO ACCIDENT, NEGLIGENCE, ALTERATION, MODIFICATION, ABUSE, MISUSE, ANY USE CONTRARY TO THE MANUFACTURER'S INSTRUCTIONS, NORMAL WEAR AND TEAR, OR ACTS OF GOD.  THE ORIGINAL PURCHASER AS USED HEREIN SHALL MEAN THE PERSON OR PARTY WHO PURCHASES THE PRODUCT AS INDICATED ON THE SALES RECEIPT OR PURCHASE ORDER ISSUED BY SMART DISPLAY OR AN AUTHORIZED DEALER.

THIS WARRANTY IS YOUR ONLY REMEDY.  NO OTHER WARRANTIES, SUCH AS FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSED OR IMPLIED. SMART DISPLAY IS NOT LIABLE FOR LOSS OF USE OF THE PRODUCT, INCONVENIENCE, ACTUAL OR ALLEGED DAMAGES WHETHER DIRECT OR INDIRECT OF ANY KIND, INCLUDING LIABILITY FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF THE USE OF, OR INABILITY TO USE THE PRODUCT, ACTUAL OR ALLEGED LABOR, INCLUDING THE COST OF REMOVING ANY PART, INSTALLATION, REINSTALLATION, FREIGHT CHARGES, TRANSPORTATION, OR OTHER RELATED CHARGES.
